Nom Nom Cakes/ Lana McIntire will make every possible effort to create your custom dessert that has been discussed and quoted via quick books. A 50% non-refundable deposit is required to hold your date and to place your order. Orders that are placed within 2 weeks of the due date will need to be PAID IN FULL. Payments can be made directly through your customized invoice through quick books.

***Deposits/ payments must be received within 24 hours of receiving your contract or the contract is voided and no order will be placed.

 

Design Confirmation

In any event that there is an error on the cake order form, it is YOUR responsibility to make us aware of the needed changes. Order changes can be made up to 7 days from the event date (additional changes may apply). All cakes are custom made and no two cakes will ever be exactly the same. Nom Nom Cakes reserves the right to make any changes to the final cake. The cake order form is a guideline for colors, design, flavors, and decorations but DOES NOT guarantee the final product.

Weddings

All wedding cake orders require 60 days notice. A $50 minimum “Save the Date” deposit is required for us to place your order and reserve your event date/ time. Wedding orders must be PAID IN FULL 1 month prior to wedding date. There will be no order changes allowed within 1 month of the event date. In the event of an event cancellation your payment is fully refundable up to 60 days prior to your scheduled event date and will be issued within 14 days of event cancellation notice. If your event is cancelled between 59- 31 days prior to the scheduled event date a 50% refund will be issued within 14 days of event cancellations notice. There are no refunds applicable for event cancellations within 30 days of the scheduled event date.

 

Delivery/ Pick up

When picking up your custom dessert please be sure to alot enough space in your vehicle for the boxes to lay flat and secure.

Once your items have been delivered/ picked up Nom Nom Cakes/ Lana McIntire is no longer responsible for any damages incurred by your custom dessert and will not assume any responsibility for damage or injury to any persons that come into contact with or consume your custom dessert. Since Nom Nom Cakes are made with ingredients that will melt in the heat, cakes should never be left in direct sunlight or in a hot vehicle. Cakes should be transported in a cool flat area with plenty of space. Any repairs or additional cakes will be subject to additional fees. If you have chosen to have your cake displayed in direct sunlight, Nom Nom Cakes is not responsible for damage to cakes beyond delivery. If you have chosen to pick up your custom dessert/ Cake Nom Nom Cakes is not responsible for cakes melting in your car.

In the case of an unavoidable delivery occurrence, such as a car accident, poor road conditions, inclement weather etc, Nom Nom Cakes is only responsible for refunding the price of the cake placed in your order.

Cancellations and Refunds

Any cancellations made prior to the final payment date will forfeit any money/ deposit paid to Nom Nom Cakes/ Lana McIntire. Due to tedious, handcrafted nature of our products, we are unable to provide refunds or exchange custom cakes, tarts, pies, cupcakes and cookies. Cake flavor and texture is subjective. Refunds requested due to flavor or texture after cake has been accepted and picked up will not be honored. You may qualify for a store credit if the product is brought back to us and the quality of the cake flavor or texture is determined not to meet our standards (Our cakes are tasted daily to insure highest possible quality). Quality determination is solely at the discretion of Nom Nom Cakes. Our cakes are exceptionally moist. Keep in mind variety in temperature and humidity may impact the flavor, overall design, or texture of the cake to some degree. Please understand we cannot control changes in texture or changes in color or shape due to weather conditions. Cakes must be brought back to us within a timely manner, preferably with 24 hours of pick up - please call or email us promptly to let us know of the issue. Please understand that we cannot issue refunds for cakes that have already been completely eaten. *Store credit percents are based on how quickly the cake is returned, how much has been consumed, and what we determine the quality to be. Store credits of any kind will not be issued to customers who do not contact us within 48 hours. 

If you come to pick up or if upon delivery the cake does not meet your expectations, we will give you a refund (minus 25% handling/cancellation fee). This refund will be given as a store credit (no cash/money refunds will be given) NOTE: If we give you a refund, you CANNOT keep the cake. You can only get the refund if you refuse to “accept” the cake. We will NOT negotiate a partial refund if you keep the cake. This is a “take it, or leave it” policy. We are not responsible for any expense you may incur for replacing our cake.

***We do not give refunds under any other circumstances. Refunds are only given within 7 days.

 Changes and cancellations to retail orders are accepted until 120 hours (5 days) prior to scheduled pick up time. No refunds will be provided for any payments made on the order no matter the amount - if canceled at least 120 hours in advance we will be happy to transfer any payment made on that order to another order within 3 months from that date. We will provide no other refunds regardless the circumstances. 3D Cakes require at least one week's notice if changes want to be made to the cake, to change the date, or to cancel. You will be required to pay the full amount if the order is cancelled with less notice.

Allergies

Your items have been baked and decorated in a home kitchen and may contain or come into contact with milk, eggs, wheat, nuts, and any other allergens. You agree to notify your guests of the risk and hold Nom Nom Cakes/ Lana McIntire harmless of any allergic reactions.

By sending your deposit/ paying in full you agree to the above details, terms and conditions.

Food Colorings

Food colorings will not match your event colors perfectly. Nom Nom Cakes will make every effort to recreate the colors you are looking for, but there will be slight color variations.

Nom Nom Cakes promises you the best product and service we can provide. Its always our goal to exceed your expectations and truly believe a referral is the best compliment. It is your responsibility to inspect the cake upon delivery and contact us with any concerns immediately.
